Consent to Receive Communications
You agree to receive text messages and emails from:
- Chapel Desk / Spearmint LLC: Service-related notifications, account updates, security alerts, product announcements, and promotional messages about Chapel Desk features and services.
- Participating Churches: Messages sent by churches using the Chapel Desk platform, which may include event notifications, announcements, devotionals, prayer requests, newsletters, and other church-related communications.
Your consent covers both automated and manually-sent messages. Message frequency varies depending on your interaction with Chapel Desk and the churches you engage with. You may receive multiple messages per week from Chapel Desk and/or participating churches.
Message and Data Rates
Message and data rates may apply. Standard messaging rates from your wireless carrier will apply to text messages. Check with your mobile carrier for details about your messaging plan. Spearmint LLC and participating churches are not responsible for any charges you may incur from your carrier.
Opt-Out and Unsubscribe
You may opt out of receiving text messages or emails at any time:
- Text Messages: Reply STOP to any text message to unsubscribe from that specific sender's messages. You may need to send STOP separately to Chapel Desk and to each church if you wish to stop all messages.
- Emails: Click the "Unsubscribe" link at the bottom of any email, or contact the sender directly to be removed from their list.
- Help: Reply HELP to any text message for assistance, or contact us at [email protected].
Opting out may affect your ability to receive important service notifications from Chapel Desk or updates from your church.
Information We Collect and Use
When you provide consent, we collect and use your contact information (phone number and/or email address) to send you the communications described above. Your information may be shared with participating churches as necessary to facilitate their communications with you. We handle your information in accordance with our Privacy Policy.
Third-Party Service Providers
We may use third-party service providers (such as email delivery services and SMS gateway providers) to send messages on behalf of Chapel Desk and participating churches. These providers are contractually obligated to protect your information and use it only to deliver the requested communications.
Carrier and Network Limitations
Chapel Desk and Spearmint LLC are not liable for delayed or undelivered messages due to carrier network issues, device compatibility, spam filters, or other technical factors beyond our control. We do not guarantee delivery of any message.
No Emergency Services
Do not use text messaging or email for emergency communications. Text messages and emails are not monitored 24/7 and should not be used to report emergencies. In case of emergency, call 911 or your local emergency services.
Age Requirement
By providing your consent, you represent that you are at least 18 years of age or have obtained permission from a parent or legal guardian to receive these communications. If you are under 18, a parent or guardian must consent on your behalf.
Changes to Terms
We may update these Communication Consent terms from time to time. Material changes will be communicated via email, text message, or by posting an updated version on our website. Continued use of the service after changes indicates your acceptance of the updated terms.
Limitation of Liability
To the fullest extent permitted by law, Spearmint LLC, Chapel Desk, and participating churches are not liable for any damages, claims, or losses arising from: (a) your receipt or non-receipt of text or email messages; (b) carrier charges or fees; (c) unauthorized access to your device; (d) any content of messages sent by churches using the platform; or (e) any technical issues, delays, or errors in message delivery.
Churches using Chapel Desk are solely responsible for the content and frequency of their own communications. Spearmint LLC acts as a technology platform provider and is not responsible for the actions, messages, or policies of individual churches.
Governing Law and Dispute Resolution
These terms are governed by the laws of the State of Minnesota, United States, without regard to conflict of law principles. Any dispute arising from or relating to these Communication Consent terms or your use of Chapel Desk communication services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, or in the state or federal courts located in Minnesota, at Spearmint LLC's sole discretion.
Compliance with Laws
We comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and other applicable laws governing electronic communications. By providing consent, you acknowledge that you have the legal authority to provide the contact information and consent to receive messages at that number or email address.
